WHO WE ARE

Combining unique expertise in both arranging financing and the legal work necessary to negotiate contracts to serve the financings, we have over 25 years' experience in assisting clients exclusively in the solid waste, recycling and renewable energy industry. We have arranged financing for everything from collection vehicles, waste carts and bins, transfer stations/material recovery facilities, to organic waste projects creating electrical energy or gas.

$9 Billion in Financing to Date

Mr. Rose has been responsible for arranging approximately $9 billion in financing for these specialty companies including periodic renewals and expansions of credit agreements. These financings have included single and multi-lender “recourse” financing for companies and non-recourse “project” financing” of facilities. He has helped companies borrowing as little as $10 million to those requiring multi-bank transactions with total commitments in the hundreds of millions.
 
Using his legal background to negotiate or improve existing contracts for solid waste and/or recycling services and the major contracts required for a successful “project finance” is another factor in Mr. Rose’s success in arranging financing for his clients. Fees are generally only due if there is a successful financing and assistance with contract negotiation is included in the financing fee.

The large client list also gives Mr. Rose and team a unique ability to obtain the best terms and pricing possible from the few banks that understand this industry. He is a large source of business for these banks but uses that “leverage” to insist on the terms we seek for clients. Banks change priorities and even their culture periodically and that can be a detriment to a client. While we never set out to advise that a client change banks, in some cases it is necessary—even crucial—to a company’s continued opportunity to grow and increase profits while maintaining service levels. And, many companies have good bankers but they don’t know much about the unique aspects of our industry. The bankers with whom we primarily work specialize in solid waste, recycling and renewable energy projects.

Mr. Rose is a graduate of Stanford University (A.B. 1974) and the University of California, King Hall, where he received his law degree (J.D. 1979).
 
He was admitted to the California Bar in 1979, and is a member of the American Bar Association and the National Association of Bond Lawyers.

He has actively participated in legislative and regulatory work related to tax exempt finance and both the Internal Revenue Service and Securities and Exchange Commission have quoted Mr. Rose in publications related to those processes.
